No, that's not a Christmas in June promo....that's one example of the flyers that seem to have gotten Cosmo's Nightclub and Lounge in Boca Raton in a bit of hot water.

They are facing a civil lawsuit in the Palm Beach County Circuit Court after 7 models alleged their images were used in social media promotions without their permission, according to a complaint recently filed on May 26th.

According to the complaint, the plaintiffs allege Cosmo’s used their images, likenesses or identities over a period of several years to advertise, promote and market the nightclub through social media accounts associated with the business.

The lawsuit claims the images were used in promotional materials for nightclub events without the models’ consent, without negotiated licensing terms and without payment.

The complaint alleges the use of the images created a misleading impression that the models were affiliated with Cosmo’s, had agreed to promote the business, had appeared or would appear at events there, or worked as dancers or entertainers for the nightclub.

This lawsuit brings claims for violation of Florida Statute 540.08, common law invasion of privacy by misappropriation, common law conversion and unjust enrichment.

The complaint states that each plaintiff works in modeling, acting, hosting, social media or related professional work where image, reputation and brand control are part of their livelihood.

The lawsuit also claims unauthorized commercial use of those images can affect the ability to negotiate paid work, control endorsements and protect professional reputation.

The plaintiffs are seeking $50,000+ in damages!!!
